Annapolis Point System Lawyer

An Annapolis point system lawyer knows about traffic laws and violations. If a person is convicted of a violation in the Maryland Transportation Article in either the Maryland District Court or Circuit Court, the Court notifies the MVA of that conviction. The MVA then assesses the number of points associated with the traffic offense to the person’s driving record.

A person should consider hiring a qualified Maryland point system lawyer as soon as they receive a Maryland moving violation ticket. Most moving violations in Maryland come with at least two points that will automatically be put on the person’s driver’s record if the individual pays it and does not contest it. It is important to not receive any points on your record because it may lead to severe consequences on your insurance rates or even on your livelihood if you are a commercial driver.

Determining Points

The Maryland Annotated Code or the Code of Maryland Regulations identifies the number of points that are assigned to each traffic violation.

How Long Do Demerit Points Last?

Points will remain on a person’s driver’s record until they are expunged by the MVA after the violation. After two years from the violation, the points are not current anymore. An insurance company or employer can find out how many points are on a person’s record because it is public information for three years from when the violation occurred. The points are removed automatically from a person’s driver’s record after three years if the person has not committed another moving violation or other criminal offense involving a motor vehicle during the three-year period. Their license has not been suspended or revoked, and they have never been convicted of driving while intoxicated, fleeing the scene of an accident, or any similar violation.

Accumulating Too Many Points

How many points a person accumulated over the previous two years determines what action the MVA might take. When the MVA adds more points to a person’s record, they review the record for the number of points that person has accumulated. If the person accumulated three to four points, the MVA sends them a warning letter. The warning letter tells them that more stern measures will be taken by the MVA if they get another infraction.
If someone accumulates five to seven points, they are required to enroll and complete a driver improvement program. These are offered across the state by various third party companies and may vary depending on which company the person uses.
If someone accumulates eight to eleven points, they receive a notice of suspension. As they accrue several more points, they will receive a notice of revocation, which means they must give their driver’s license to an MVA office. Once that period of time is complete, they must go to the MVA to apply for a new license. Talk to an Annapolis point system lawyer for more information.

Long-Term Impact

With regards to a person’s insurance, the insurance company may drop the person or increase the person’s premium, depending on the number of points they have on their license. Additionally, if a person is suspended or revoked, they no longer have the ability to drive anywhere.
