Classifying Felony Crimes

If a person’s charge is more serious, and therefore classified as a felony, the case may be heard in either district court or circuit court, depending on the severity of the charge. Examples of felony crimes in Maryland are:

  • Burglary in the First Degree. Maryland Code 6-202. Punishable by a maximum term of 20 years in prison
  • Arson in the First Degree. Maryland Code 6-102. Punishable by a jail term of up to 30 years, or a fine of not more than $50,000, or both
  • Assault in the First Degree. Maryland Code 3-202. Punishable by imprisonment of not more than 25 years

As can be seen from the differing degrees of assault, the severity of the crime is often linked to the potential penalties. Another example of this is the concept of a crime of violence. This is a special sentencing structure created for repeat offenders in Maryland under Maryland Code 14-101.

The code imposes mandatory minimum jail terms of 10 years for a second offense, 25 years for a third offense, and life imprisonment for a third offense for certain, very serious crimes. Examples of this include kidnapping, arson in the first degree, and carjacking.
