Driving Under the Influence in Garrett County
Most alcohol-related driving offenses stem from avoidable traffic stops resulting from simple offenses such as speeding or failing to signal when turning. You should be aware of this when driving. If you are pulled over and the police officer suspects that you have been drinking, he or she will likely conduct field sobriety tests to determine your level of intoxication. Should he or she believe that your performance in these exams indicates that you may be under the influence of alcohol, you may be asked to perform a breath alcohol exam. You may refuse the breath test, but this will result in an automatic suspension of your diving privilege. You do, however, have every right to refuse to provide the officer with any information besides that on your driver’s license. Anything you say can be used against you in court, so it is advised that you speak to your Garrett County DUI attorney before speaking with any authorities.
Should you be arrested for driving under the influence or driving while impaired (DWI), you will likely be expected to appear before a judge at the Garrett County District Court. You will also have to request an MVA hearing if you wish to retain your license and driving privileges. The attorneys with our firm can provide you with a strong defensive strategy to ensure that you receive the most favorable outcome possible in both your MVA hearing and your drunk driving case.

Garrett County District Courthouse
If you have been charged with DUI, and you and your attorney are unable to negotiate a plea agreement that avoids a court date, your case will be heard at the district courthouse, located at 205 3rd Street in Oakland, Maryland. The administrative clerk for the district court is Kathleen M. Stanford. For more information about the court, including its hours of operations and important information about the proceedings that happen there, you can contact the court directly at (301) 334-8020. Parking is provided at the courthouse, but the lot often fills up on busy days and it may not be available by the time you arrive. We recommend that you leave early for your court date so that you don’t let something like finding a parking space prevent you from arriving on time. There is additional parking in the area.
Directions
Oakland, Maryland is in the westernmost part of Maryland, so any state residents that will be making their way to the courthouse will likely be coming from the east. If you are starting your trip from the Baltimore area, you will start your trip by getting on to I-68 W/US-40 towards Oakland. After roughly 90 miles, take Exit 14A and merge on US-219 S (this is a continuation of US-40). Keep left at the fork and continue onto 219 S/Main Street. After about 19 miles, the court will be on the right.
