Possession with Intent to Distribute

The jury deliberated for less than an hour before finding my client not guilty of all charges. The prosecutor that handled the case was subsequently demoted for misconduct and other ethical violations.
Felony Theft – Montgomery County Circuit Court
State’s request for over $100k in restitution related to an elaborate covid related theft of medical equipment was denied. The state failed to provide accurate records of all alleged occurrences and the judge could not find that they met their burden of proof.
Attempted Murder – Montgomery County Circuit Court
State was forced to dismiss a case involving a shooting outside of an apartment complex in Silver Spring, Maryland. The evidence in the case always pointed at someone other than our client but the investigators and law enforcement refused to acknowledge they were on the wrong track. On the morning of trial, just prior to selecting a jury, the prosecutor conceded this issue and dismissed the criminal case.
DUI
In downtown Bethesda on New Years Eve, an elderly client got into a fender bender with another vehicle while attempted to park. Law enforcement showed up and was certain he was impaired by alcohol. After a bench trial in the Montgomery County District Court, the judge determined the government’s evidence failed to acknowledge the age of the Defendant and the multiple medical conditions he suffered from that could have contributed to his poor performance on field sobriety tests. He was found not guilty.
