Common Criminal Defense Cases
Frederick criminal lawyers represent clients in both district and circuit courts. While most criminal offenses are dealt with in district courts, more serious criminal charges are heard in circuit courts. If a person’s charge is classified as a misdemeanor, the case will be heard in district court. Examples of misdemeanor charges in Maryland include:
- Assault in the Second Degree. Maryland Code 3-203. Punishable by imprisonment of less than 10 years, or a fine of not more than $2,500, or both.
- Maryland Code 3-803. Punishable by imprisonment of not more than 90 days, or a fine of not more than $500, or both.
- Trespassing on Posted Property. Maryland Code 6-402. Punishable by imprisonment of not more than 90 days, or a fine not more than $500, or both.
Classifying Felony Crimes
If a person’s charge is more serious, and therefore classified as a felony, the case may be heard in either district court or circuit court, depending on the severity of the charge. Examples of felony crimes in Maryland are:
- Burglary in the First Degree. Maryland Code 6-202. Punishable by a maximum term of 20 years in prison
- Arson in the First Degree. Maryland Code 6-102. Punishable by a jail term of up to 30 years, or a fine of not more than $50,000, or both
- Assault in the First Degree. Maryland Code 3-202. Punishable by imprisonment of not more than 25 years
As can be seen from the differing degrees of assault, the severity of the crime is often linked to the potential penalties. Another example of this is the concept of a crime of violence. This is a special sentencing structure created for repeat offenders in Maryland under Maryland Code 14-101.
The code imposes mandatory minimum jail terms of 10 years for a second offense, 25 years for a third offense, and life imprisonment for a third offense for certain, very serious crimes. Examples of this include kidnapping, arson in the first degree, and carjacking.
Frederick criminal lawyers work with clients charged with everything from misdemeanors to felonies with potential life imprisonment to protect their liberty.
