First vs. Second Degree Assault in Maryland

Both first and second degree assault charges are umbrella terms for assault, battery, or assault and battery. A Wicomico assault lawyers can go over with you the accusations you face. Assault charges in Maryland are broken down into two degrees:

  • Assault in the first degree is the more serious charge of the two. This means that you are accused of seriously injuring another person or attempting to do so, and/or assaulting with a firearm. The penalties for this charge are described in Maryland’s Criminal Law Code 3-202, stating that a person guilty of this crime is subject to a sentence of up to 25 years imprisonment. First degree assault is also defined as a crime of violence. Anyone serving a sentence for a first degree assault will have to serve fifty percent of that sentence before being eligible for parole
  • Assault in the second degree describes the lesser crime as injuring another person to a lesser degree. or placing a victim in fear of an imminent batter. Second degree assault in Maryland is also the charge for assaulting a law enforcement officer or parole officer. According to Maryland Criminal Law Code 3-203, a person who violates this law is guilty of a misdemeanor offense and is subject to up to 10 years imprisonment and a fine of $2500.

Charges can be dropped from the first to the second degree, as well as dropped altogether. The conditions under which you were arrested and your defense strategy will determine how you are charged.
